If you have a speeding citation issued in a construction zone, you are not eligible for probation if workers are present. It is essential to know that workers do not have to be present at the exact place you receive the citation; rather, workers anywhere in the construction zone will count. This is especially important in extended construction zones where you might not see any workers, but the “workers present” will apply if workers are anywhere within the construction zone. In addition, the fine can be doubled if workers are present.
The good news is we can get “workers present” waived in some courts. This means we may still be able to get a deferred disposition offer even if you have an allegation of speeding in a construction zone with workers present.
If you have a commercial driver’s license (CDL), you are not eligible for deferred disposition to have your ticket dismissed. Still, we may have other ways to reduce CSA points or get the ticket dismissed depending on the jurisdiction. This includes speed reductions, pre-trial diversion programs, and citations swaps. We cannot keep all speeding tickets off of your record if you have a CDL, but we do have a good success rate depending on where the ticket was issued and whether you were driving a commercial vehicle.
